2. The petitioner is in custody in connection with S.T. No. 01 of 2022 arising out of Gamhariya P.S. Case No. 154 of 2020 for the offence punishable under sections 302, 120-B and 34 of the Indian Penal Code and section 27 of the Arms Act, lodged on 15.09.2020 by the informant, Rohini Devi.

3. As per the prosecution story, the informant has alleged that the petitioner herein along with other accused persons due to land dispute, came and it is alleged that in the presence of the informant and her daughter, Anshu Yadav opened fire killing her husband on the spot.

4. In this case, a report was called for, considering the fact that the petitioner is in custody since the year 2020 and as per the report dated 01.08.2024, out of eleven charge sheet

Patna High Court CR. MISC. No.23128 of 2024(4) dt.27-09-2024 2/2 witnesses, eight prosecution witnesses have been examined, cross examined and discharged till 31.07.2024 and only three witnesses are to be examined.

5. The short F.I.R. clearly states that it was the petitioner who opened fire in front of the informant causing death of her husband.

6. Expecting the learned Trial Court to conclude the trial this year itself, the bail application stands rejected. (Rajiv Roy, J) vinayak/- U T
