JUSTICE VIKASH JAIN ORAL ORDER 23-08-2016 Heard learned senior counsel for the petitioner and learned APP for the State assisted by learned counsel for the informant.
2. The petitioner is in custody since 17.02.2016 in connection with Shahpur P.S. Case No. 48 of 2016 for the offences alleged under Sections 147, 148, 149, 341, 324, 307 and 302 of the Indian Penal Code and Section 27 of the Arms Act.
3. It is submitted that the petitioner has been falsely implicated and even according to the first information report, the main assailants who fired upon the informant's uncle and the driver of the vehicle are Haresh Mishra and Brajesh Mishra. The petitioner has been implicated only due to political rivalry.
4. Learned APP for the State assisted by learned counsel for the informant appearing suo motu have opposed the bail petition by referring to further averments made in the FIR that other occupants of the vehicle including the petitioner also fired.
5. Having regard to the nature of accusations and
Patna High Court Cr.Misc. No.33145 of 2016 (2) dt.23-08-2016 2/2 gravity of offence alleged, this Court is not inclined to grant the privilege of bail to the petitioner. The bail petition stands dismissed.
