JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution case is that the petitioner resorted to fire in protest of informant entering into the orchard of the petitioner.

It is submitted by learned counsel for the petitioner that from the FIR itself, it appears that no firearm injury was caused to the informant, statement to that effect has been made in para 8 of the petition. It is further submitted that the informant has subsequently retracted from his initial version and filed a petition to that effect before the learned court below. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Andar P.S. Case No. 44 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
