The petitioner seeks bail in connection with Excise Case No. 1544 of 2017, arising out of Bhabhua P.S. Case No. 614 of 2017 dated 02.10.2017 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. 47.7 litres of liquor is said to have been recovered from the possession of the petitioner. Learned counsel for the petitioner has submitted that petitioner has only been falsely implicated in this case because of his having been made accused earlier in the case of similar nature. It has further been submitted that in the earlier case which was lodged against him for similar nature of occurrence, he has been granted bail.

Regard being had to the aforesaid facts, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Special Judge-cum-Additional Sessions Judge, IVth, Kaimur at Bhabua in connection with Excise Case No. 1544 of 2017, arising out of Bhabhua P.S.
