Petitioner apprehends arrest in a case registered for the offence punishable under Section 30a and other allied sections of the Bihar Prohibition and Excise Act. Prosecution's case, in brief, is that 53.820 liters of foreign liquor was recovered from the house of co-accused Bishundeo Bhagat. Said Bishundeo Bhagat was arrested on the spot. However, the petitioner who was also present on the spot managed to escape.
Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner's name has come in this case on the confessional statement of the said co-accused. Petitioner has got no criminal antecedent. Nothing incriminating has been recovered from his
Patna High Court CR. MISC. No.18013 of 2020(2) dt.12-06-2020 2/2 possession and petitioner has no concern with the said recovery. Considering the facts of the case, let the petitioner, above named, in the event of surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge cum Special Judge, Excise Act, Saran in Sonpur (Pahleza ghat opposite party) Police Station Case No. 05/2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
