Petitioner is languishing in judicial custody since 04.10.2017 in connection with Kotwali P.S. Case No. 521 of 2017, G.R. No. 6215 of 2017 for offences punishable under Sections 401, 413, 414, 379, 411, 34 of the Indian Penal Code. The prosecution case, as lodged by the informant, is that he is rickshaw-puller and three miscreants including the petitioner were caught while stealing his daily income of Rs. 1750/-. Earlier also they had stolen Rs. 450 from the informant and on search by the police Rs. 620 was found from the possession of the petitioner along with one mobile. Accordingly a seizure list

Patna High Court Cr.Misc. No.1126 of 2018 (3) dt.13-02-2018 2/2 was prepared.

It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and has been falsely implicated in the aforesaid case. He submits that charge-sheet has already been submitted and there is no allegation of tampering of the prosecution witnesses by the petitioner. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 521 of 2017, G.R. No. 6215 of 2017.
