JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with G.O. Case No. 627/2018, arising out of Beheri P.S. Case No.140/2018 for the offence registered under Section 30(a) of Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner is in custody since 13.07.2018 in connection with seizure of 150.75 litres liquor. He further submits that nothing was recovered either from physical possession or from the house of the petitioner. It is recovered from the backyard of the house of younger brother.
Considering the aforesaid, let the petitioner named above is directed to be released on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like
Patna High Court Cr.Misc. No.54436 of 2018 (2) dt.20-09-2018 2/2 amount each to the satisfaction of learned Additional Sessions Judge-IV-cum-Special Judge, Excise, Darbhanga, in connection with Beheri P.S. Case No.140/2018.
