The petitioner apprehends his arrest in Parbatta (Maraiya) P.S. case No. 70 of 2018 registered under Section 363, 366A/34 of the IPC.
The informant, father of the victim, alleged that petitioner with the help of his family members kidnapped his minor daughter.
The learned counsel for the petitioner submits that the victim appeared and made her statement u/s 164 of the Cr. P. C. She disclosed that she voluntarily left her house and solemnized marriage with the petitioner. It is further submitted that the informant later on compromised the case.
Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that victim,
Patna High Court CR. MISC. No.18457 of 2019(2) dt.27-03-2019 2/2 who disclosed her age as 18 years, stated that she voluntarily left her house, solemnized marriage with petitioner and denied the factum of her kidnapping, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Khagaria in connection with Parbatta (Maraiya) P.S. case No. 70 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
