JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-09-2020 Supplementary affidavit for removal of the defect has already been filed and the office has reported that the defects have already been removed through supplementary affidavit though the copy of the aforesaid supplementary affidavit has not been served to the State.
Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 395 of the Indian Penal Code.
Admittedly, petitioner is not named in the first information report and the impugned order goes to show that the name of petitioner came in confessional statement of Bipul
Patna High Court CR. MISC. No.20567 of 2020(4) dt.21-09-2020 2/2 Kumar as well as Aslam Rajavi. Moreover, co-accused Bipul Kumar as well as Aslam Rajavi have already been granted privilege of bail by different Benches of this Court. No doubt, the petitioner does have criminal antecedent of two case but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate4th, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 181 of 2014.
