The petitioner seeks bail in a case registered under Sections 461/379 of the Indian Penal Code.

The prosecution case in brief is that the money kept in ATM was looted by unknown thieves.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 19-11-2018. Charge sheet has already been submitted. The petitioner is not named in the FIR. There is no recovery of any incriminating article from possession of the petitioner. No TIP of the petitioner was conducted. The offences are triable by the Magistrate.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda in connection with Laheri P.S. Case No. 226 of 2018.
