JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-12-2013 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Section 365/34 of the Indian Penal Code.
It is alleged that the son of the informant was being taken by the accused persons to Jamsedpur to attend a marriage and from there the son of the informant disappeared. It is submitted by learned counsel for the petitioners that the victim was dumb and deaf when he went missing on 27.02.2013 and very next day of the occurrence, the police of Jamsedpur was informed when the petitioners were not named, subsequently the paper publication was made, there also the petitioners were not named. Now the victim has returned and the informant has retracted from his initial version
Patna High Court Cr.Misc. No.38916 of 2013 (2) dt.24-12-2013 2/2 and filed a petition to that effect before the learned court below, the same has been brought on record by way of supplementary affidavit.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Sakra P.S. Case No. 126 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/-
