JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being mother of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. The accusation is killing the daughter of the informant after one year of marriage for non-fulfillment of dowry demand by administering poison.

It is submitted by learned counsel for the petitioner that accusation of administering poison is omnibus and general against the entire in-laws family and the said fact, as claimed by the informant, was conveyed to him by the victim herself, but the post-mortem reflects no external injury. The cause of death has not been ascertained and viscera has been kept reserved. Considering the fact that post-mortem does not reflect

No.33109 of 2015 (2) dt.12-08-2015 2/2 any external injury and the informant is a lady, let her be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Patepur P.S. Case No.160 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
