Mr. Pushpa Sinha-1, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 16-04-2025 Heard Mr. Gajendra Kumar Singh, learned counsel appearing on behalf of the petitioner and Mr. Pushpa Sinha-1, learned APP for the State.
2. The petitioner seeks pre-arrest bail in connection with Gupra P.S. Case No. 120 of 2024 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2022.
3. Learned District Court is directed to call for report of the seized vehicle from the District Transport Office, Gaya, on the basis of its Engine Number and Chassis Number, which have been mentioned in the FIR and the seizure list. If it is found that the said vehicle is stolen, the chance of complicity of the petitioner in the alleged offence cannot be ruled out, considering the large consignment of illicit liquor being

In case the vehicle is not stolen and on the basis of Engine Number and Chassis Number, the petitioner is found not to be the owner of the said vehicle, the petitioner is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise, Court No.4, Gaya, in connection with Gurpa P.S. Case No. 120 of 2024, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
4. Accordingly, the present pre-arrest bail application stands disposed of.
