JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sadar P.S. Case No. 421 of 2017 registered under Sections 143, 144, 158, 290, 414, 272 & 273 IPC of the Indian Penal Code and Section 25(1-B)A, 25-1-A, 25-1AA, 25-1AAA, 26, 26(ii), 35/27 of the Arms Act and Section 30(a) of the Bihar Prohibition and Excise Act.

The accusation is that while a birthday party was being celebrated at the house of Surendra Rai, and several persons have participated with arms and were taking wine, informant along with other police officials raided his house and 68 bottles of Indian

Patna High Court Cr.Misc. No.7483 of 2018 (2) dt.08-02-2018 2/2 made foreign liquor was recovered. 12 vehicles were also found parking outside. Petitioner along with twenty persons was apprehended and from his possession one loaded country made pistol was recovered.

Learned counsel for the petitioner submits petitioner has no criminal antecedent and is in custody since 24.08.2017. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Spl. Judge Excise, Muzaffarpur, in connection with Sadar P.S. Case No. 421 of 2017. Out of two sureties, one surety must be the close relative of the petitioner.
