ANJANA MISHRA ORAL ORDER 25-03-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Salkhua (Banma) P.S.Case No. 60/2014, registered for the offence under section 7 of E.C.Act.
Learned counsel for the petitioner submits that the petitioner had purchased 100 Ltrs of Kerosene oil and while he was coming he was caught and on that basis the case has been registered. However, it is submitted that when an enquiry was made, it was revealed that the petitioner was not in possession of the said kerosene oil and that he has never tried to receive the same. It was further submitted that the stock of the dealer where it was said to have purchased was found adequate and therefore the allegation against the petitioner, as alleged, is wholly false.
Patna High Court Cr.Misc. No.40004 of 2014 (2) dt.25-03-2015 2/2 Considering the aforesaid submission, the petitioner, named above, in the event of his arrest ro surrender in the court below within two weeks from the date of receipt/ production of a copy of this order is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., at Saharsa, in Salkhua (Banma) P.S.Case No. 60/2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
