The petitioner seeks bail in a case instituted under Sections 413, 414, 467, 468, 471 and 120B of the Indian Penal Code.

The allegation against the petitioner is that he is also involved in committing theft of the vehicle along with other coaccused persons. It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.05.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. Nothing has been recovered from the possession of the petitioner. The

Patna High Court Cr.Misc. No.34670 of 2016 (3) dt.03-10-2016 2/2 petitioner has been made accused due to mistake of fact. The other co-accused persons have been granted bail vide Cr. Misc. No. 37076 of 2016.

On behalf of the state it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari (East Champaran), in connection with Sangrampur P.S. Case No. 52 of 2016, corresponding to G.R. No. 2287 of 2016. (Sudhir Singh, J.) Amit/- U T
