2. The petitioners seek regular bail in connection with Raghopur P.S. Case No. 30 of 2024 registered for the offence under Section 414 of IPC and Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2018.
3. It is a case of recovery of total 200 liters country made liquor from a motorcycle bearing Reg. No. BR01DH8666 and BR33N3782.
4. Learned counsel for the petitioners submits that the petitioner are innocent committed no offence and have falsely been implicated in the present case. There is no independent
Patna High Court CR. MISC. No.21462 of 2024(2) dt.19-03-2024 2/2 witness of seizure list. They are in custody since 07.02.2024.
5. However, learned APP for the State opposed the prayer for regular bail.
6. Considering the aforesaid facts and circumstances, the above named petitioner is directed to be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Court of Exclusive Special Excise Court No. II cum Additional District and Sessions Judge, Vaishali at Hajipur in connection with Raghopur P.S. Case No. 30 of 2024.
7. The trial Court is directed to conclude the proceeding of framing of charge according to law within a period of 15(fifteen) days from the date of receipt of a copy of this order. However, it is made clear that if the charge-sheet has not been submitted then the petitioners shall released on bail on above conditions and he shall be present physically on each or every date before the Trial Court till conclusion of the proceeding of framing of charge.
