The petitioner seeks bail in Dehri (T) P.S. Case No. 989 of 2017 registered under Sections 30(A) and 38(i)(ii) of the Bihar Prohibition and Excise Amendment Act, 2016. 34.40 litres of country made liquor is said to have been recovered from the cow shed located near the house of the petitioner Pramod Kumar and he was apprehended. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. The petitioner has neither any concern with the said cow shed nor with the seized liquor. He

Patna High Court Cr.Misc. No.2360 of 2018 (2) dt.24-01-2018 2/2 has no criminal antecedent. The petitioner has been languishing in custody since 02.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Court, Excise, Rohtas at Sasaram in connection with Dehri (T) P.S. Case No. 989 of 2017.
