The petitioner seeks modification of the order dated 26.09.2019 passed by a Bench of this Court in Cr. Misc. No. 61517 of 2019.

By the aforesaid order, the petitioner was directed to surrender before the court below by 17.10.2019 and on surrender, he will be enlarged on provisional bail. The petitioner could not surrender within the stipulated period due to his illness.

For the reasons stated in the petition, the

Patna High Court CR. MISC. No.19058 of 2020(2) dt.03-07-2020 2/2 prayer is allowed.

The order dated 26.09.2019 is modified to the extent that if the petitioner surrenders before the court below within a period of six weeks from today, he shall be enlarged on provisional bail on the same terms and conditions as were imposed by the order which is sought to be modified.

The order stands modified to the extent indicated above.

The modification petition stands allowed and disposed off.
