The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 5/7/9/10 of the Bihar Kasth Chiran Adhiniyam, 1990 (Bihar Saw Mills Regulation Act, 1990) and Sections 41/42 of Forest Act. Allegation is that petitioner was running saw mill without any authority or licence. Six pieces of wood besides other articles were seized.

Contention of the petitioner is that in fact the saw mill is not of the petitioner nor the petitioner has got any criminal antecedent. Petitioner has been implicated on suspicion only. The offences alleged do not carry any serious punishment.

No.21505 of 2019(2) dt.05-04-2019 2/2 Considering the entire facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Forest Case No.39 of 2005, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
