Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-01-2023 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Mahila PS case no. 59 of 2021 instituted for the offences punishable under Sections 376, 511/34 of the Indian Penal Code and Section 8 of POCSO Act.

The petitioner is alleged to have entered the house of the victim girl and had tried to rape her but on an alarm being raised, her family members had arrived at the spot and then the petitioner and his accomplice had fled away. At the outset, the learned counsel for the informant has informed this Court that the trial is on the verge of completion, inasmuch as all the prosecution witnesses except the Investigating Officer, have already been examined, hence,

Patna High Court CR. MISC. No.19764 of 2022(3) dt.04-01-2023 2/2 granting bail to the petitioner, at this stage, would impede the progress of trial.

In such view of the matter, the learned counsel for the petitioner submits that the petitioner be granted liberty to renew his prayer for bail after six months while directing the learned court below to conclude the trial within six months. Accordingly, the present petition stands disposed off with a direction to the learned court of Additional Sessions Judge-Vith-cum-Special Judge, POCSO Act, Kaimur at Bhabua to ensure conclusion of the trial within a period of six months from today, however, liberty is granted to the petitioner to renew his prayer for bail after a lapse of six months from today, in case, the trial is not concluded.
