The petitioner wants to renew the prayer of bail which was earlier twice rejected by order dated 20.06.2012 and then by order dated 04.05.2016 passed in Cr. Misc. No. 16509 of 2012 and in Cr. Misc. No. 12157 of 2016 on the ground that trial has not been concluded within time as asked by the learned trial judge. The petitioner is the husband and he has tried his best to save the life of his wife, but she could not survive. Further from the report, it reveals that the learned trial judge has again sought two months time for disposal of the case.
The learned A.P.P. submits that the trial is in progress and the case was transferred resulting some delay. In the facts and circumstances stated above and considering that all the prosecution witnesses have already been
Patna High Court Cr.Misc. No.33025 of 2016 (3) dt.14-09-2016 2/2 examined and the record is going to be fixed for argument and, as such, at this stage, I am not inclined to enlarge the petitioner on bail and, accordingly, his prayer for bail again stands rejected in connection with S. Tr. No. 239 of 2012 arising out of Ramgarh P.S. Case No. 104 of 2011 pending in the court of learned 3rd Additional Sessions Judge, Kaimur at Bhabua.
However, the learned trial judge is directed to conclude the trial within the time as stated by him in his report dated 01.09.2016.
