The petitioners being the husband, mother and sister of the husband of the informant are apprehending their arrest in a case registered for the offences punishable under Sections 326/34 of the Indian Penal Code.
The accusation is of administering insecticides.
It is submitted by learned counsel for the petitioners that from the First Information Report it appears that the victim took insecticides assuming it to be a cough syrup when the informant has subsequently
Patna High Court Cr.Misc. No.39323 of 2013 (2) dt.24-12-2013 2/2 retracted from the initial version and filed petition to that effect before the learned court below when there is variation between the Fard-beyan and 164 Cr.P.C. statement.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Baisi (Dagarua) P.S. Case No. 201 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
