The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,148,149 and 307 of the Indian Penal Code and sections 25(1-B) a, 26 and 27 of the Arms Act.
It is alleged that the informant being S.I. of Police, on secret information, tried to apprehend the miscreants when the miscreants opened fire and escaped from the scene after throwing country made pistol on the place of occurrence. Subsequently, the chowkidar disclosed the name of the petitioner as one of the miscreants.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.33635 of 2015 (2) dt.13-08-2015 2/2 petitioner that omnibus and general accusation has been levelled when co accused Sadan Singh alias Sajjan Singh has been granted bail vide Cr. Misc. No. 31115 of 2014. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Maheshkhunt P.S. Case No. 35 of 2014 pending in the court of learned CJM, Khagaria. This application is disposed of with the aforesaid observation/direction.
