Petitioner, already in custody, seeks bail in connection with Town P.S.Case No. 512 of 2017, registered under Sections 419, 420, 467, 468, 471 and 34 of the Indian Penal Code. Allegation in brief is that the petitioner and others are members of the gang, used to cheat students appearing in the examination of Bihar School Examination Board for increasing their works and also customer of Home shop 18 in their name draw of false lottery. In the meantime, he intercepted a motorcycle on which three persons were sitting but they tried to escape but they were apprehended. During search the name of the petitioner transpired on the basis of statement of co-accused, Ajit Kumar and on search ATM Card, Admit card, list of persons with phone numbers etc.

Patna High Court Cr.Misc. No.57529 of 2017 (4) dt.02-02-2018 2/2 recovered from the possession of the petitioner. Learned counsel for the petitioner submits that merely on the basis of suspicion the name of the petitioner transpired and there is no eyen witness is available against the petitioner except statement of co-accused, Ajit Kumar. It is also submitted that the similarly situated co-accused persons have already granted bail vide order dated 12.01.2018 by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 448 of 2018 and the petitioner has no criminal antecedent and he is in custody since 20.09.2017. Having considered the said facts and circumstances, the petitioner, Pankaj Kumar, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Town P.S.Case No. 512 of 2017.
