JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 47 and 47A of the Excise Act and Section 137 of Railway Act.
20 litres of country made liquor is said to have been recovered from possession of petitioner, while he was traveling in a train and for that recovery, petitioner is in jail custody since 22.04.2016, without having any criminal antecedent. Moreover, having more or less similar allegation, co-accused Urmila Devi has already been granted privilege of bail by the learned court below itself.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.30726 of 2016 (2) dt.08-08-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Railway Magistrate, Gaya in connection with Gaya G.R.P. P.S. Case No. 68 of 2016.
