Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 429, 354B, 448, 436, 504 of the Indian Penal Code and 27 of the Arms Act. It is alleged that the petitioners along with others came to the door of the informant and started abusing. The informant tried to escape, then co-accused Pappu Yadav restrained him and on the order of Shiv Dhari Yadav, petitioner no. 1 Tejo Yadav @ Tej Narayan Yadav assaulted with farsa on the head of the informant, whereas petitioner no. 2 namely Ram Bharosa Yadav assaulted with iron rod. When wife of the informant case to rescue, then she was also being

Patna High Court Cr.Misc. No.34858 of 2015 (2) dt.01-09-2015 assaulted by Tejo Yadav. It is alleged that Ram Vinod Yadav took away box containing ornaments and clothes. It is submitted by the learned counsel for the petitioners that except one injury on the leg, other injury has been found to be simple. There is counter version of the occurrence.

Considering the specific allegation of assault against the petitioners, let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Kuseshwar Asthan P.S. Case No. 146 of 2015, pending in the court of learned SubDivisional Judicial Magistrate, Biraul at Benipur (Darbhanga). With the above observation this application is disposed of.
