1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Khagaria P.S. Case No.303 of 2025 instituted under Sections 126(2), 115(2), 329(4), 110, 74 & 3(5) of the B.N.S., 2023.

3. As per the prosecution case, the informant has alleged that when she alongwith her family members were sleeping in their house, in the meantime all the accused persons including the petitioner having armed with various weapons entered in the house of informant and started assaulting the informant and her family members causing injury to them. Specific allegation against the petitioner is that she attacked with knife upon the son of informant causing injury to him.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He further submits that the informant and petitioner both are gotiya and there is land dispute between them. Learned counsel submits that there is delay of 10 days in lodging the F.I.R. without any plausible explanation, which castes the serious doubt on the case of the prosecution. He further submits that the allegation against the petitioner is that she assaulted the son of informant i.e. Nikki Kumar, but there is neither any statement nor any injury report of the said Nikki Kumar on the record to corroborate the allegation made in the F.I.R.

Learned counsel submits that except the injury to the injured Ram Kumar, the husband of the informant, who has received grievous injury, the injuries to the other injured are simple in nature. He further submits that allegation of assault to the injured Ram Kumar is not on the petitioner as he has not been alleged as the assailant of the said injured Ram Kumar. Leaned counsel submits that petitioner is a women, having one criminal clean antecedent, in which she is on bail and she undertakes to cooperate in the investigation and trial of the case.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case, submissions of learned counsel for the parties and the nature of allegation leveled against the petitioner, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned C.J.M. Khagaria/ concerned Court in connection with Khagaria P.S. Case No.303 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
