JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being the in-charge of Hatha Purchase Centre of Bihar State Food and Civil Supplies Corporation, Gopalganj is apprehending arrest in a case registered for the offences punishable under Section 409 of the Indian Penal Code. It is alleged that 125.30 quintals of paddy and 17.45 quintals of heat worth Rs. 2,14,536/- found shortage. It is submitted by learned counsel for the petitioner that 1% shortage is permissible and the shortage quantity is to that extent. However, the petitioner is ready to deposit 50% of the alleged amount of Rs. 2,14,536/- before the learned court below, which will be subject to result of the case.

On deposit of 50% of the alleged amount of Rs. 2,14,536/-, let the above named petitioner be released on

Patna High Court Cr.Misc. No.33980 of 2015 (2) dt.14-08-2015 2/2 anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gopalganj in connection with Hathua P.S. Case No.52 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
