Petitioner seeks bail in a case registered under sections 188, 171(E), 141 (I) of the Bihar Panhayati Rajya Adhiniyam and various sections of the Arms Act.

One country made pistol containing 8 live cartridges and other articles including sample of ballot papers of Mukhiya election were recovered from the possession of the petitioner for which petitioner is in jail custody since 9.5.2016. Submission on behalf of the petitioner is that the petitioner has been implicated in this false case on account of political rivalry and, as a matter of fact, petitioner does not have any criminal antecedent and rival candidate of the petitioner got instituted the present case.

Patna High Court Cr.Misc. No.30545 of 2016 (4) dt.23-08-2016 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in Khaira P.S. Case no. 103/2016.
