2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act.
3 . It is alleged that 40 liters illicit liquor was recovered from two bags kept near Railway pond. Two motorcycles were also seized from the spot. Petitioner is registered owner of one of the seized motorcycles.
4. Learned counsel for the petitioner submits that no incriminating material has been recovered from seized motorcycle of petitioner. Petitioner has got no concern with the alleged recovery and he has been made accused in this case only on suspicion . Petitioner has got 1 criminal antecedent of similar

5 . Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
6. Considering the fact that no incriminating material recover from the seized motorcycle of petitioner and other circumstances of the case , in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive special Judge Excise Court No. II Muzaffarpur in connection with Motipur P.S. case No. 269 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 (Prabhat Kumar Singh, J) Koushik/- U T
