This is the second attempt on behalf of the petitioners for grant of bail in connection with Jadiya P.S. Case No.39 of 2025 registered for the offence under sections 8, 20(b) (ii) B of the N.D.P.S. Act. Earlier, the prayer of the petitioners for grant of bail was rejected by this Court vide order dated 03.09.2025 passed in Criminal Miscellaneous No.43138 of 2025.

There is recovery of 4 Kg. of ganja from each of the petitioners i.e. total recovery is of 8 Kg. of ganja from the petitioners.

Learned counsel for the petitioners submits that the petitioners are innocent and they have falsely been implicated in this case. He further submits the petitioners have clean antecedent and they are in custody since 25.02.2025. 5.

Learned APP for the State has opposed the prayer of the petitioners for grant of bail.

Considering the period of custody of the petitioners, which is from 25.02.2025 and also the fact that they have clean antecedent, this bail application is allowed. 7.

Let the petitioners, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, III -cum- Special Judge, NDPS, Supaul / concerned Court below, in connection with Jadiya P.S. Case No.39 of 2025.

This is also subject to the condition that the petitioners, after being released on bail, are directed to mark their attendance at Srinagar Police Station, District- Madhepura on first and third Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioners.

As the petitioners claim to have clean
