The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 406, 419, 504 and 120(B) of the Indian Penal Code.
It is alleged that the petitioner being the employee of Health Division of Railway was paid Rs. 6,00,000/- by the informant for providing employment in Railway. The payment was made through cheques. It is submitted by learned counsel for the petitioner that the nephew of the petitioner was married with the sister of the informant on 20.11.2011 and for the purpose of marriage the said cheque was given in September, 2009 but subsequently the relationship between the nephew of the

No.41306 of 2014 (2) dt.27-02-2015 2 / 2 petitioner and sister of the informant went sour resulted into several rounds of litigations and thereafter the present case has been registered in 2014 as retaliatory measure. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Sakra P.S. Case No. 247 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.
Muzaffarpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
