====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 06-10-2018 Heard learned counsels for the petitioner and the State.

Petitioner seeks bail in connection with Session Trial No. 425 of 2018 (Nayagaon P.S. Case No. 38 of 1999) registered for the offence punishable under sections 147, 148, 149 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing for the petitioner submits that merely on suspicion petitioner has falsely been implicated in this case. There is no specific allegation against this petitioner. Charges has been framed on 09.08.2018 (Annexure-1) against this petitioner. Moreover, similarly situated co-accused has been granted bail by a Co-ordinate Bench of this Court vide order dated 11.05.2011 passed in

Patna High Court Cr.Misc. No.61031 of 2018(2) dt.06-10-2018 2/2 Criminal Misc. No. 14900 of 2011. Petitioner is in custody since 27.06.2018.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I-cum-Special Judge, POCSO Act and NDPS Act, Begusarai in connection with Session Trial No. 425 of 2018 (Nayagaon P.S. Case No. 38 of 1999).
