The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 341, 342, 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

The allegation against the accused persons including the petitioner is of committing murder of both the sons of the informant, after opening fire with their firearms. It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.04.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not

Patna High Court Cr.Misc. No.32650 of 2016 (5) dt.23-09-2016 named in the First Information Report. His name has come in course of investigation. The co-accused Munna Kumar in his confessional statement has named the petitioner. There is no substantive evidence to suggest his implication in the present case. From perusal of the order of the Sessions Court, it is evident that the main allegation is against the co-accused Munna Kumar and Chotu Yadav @ Chotelal Yadav.

On behalf of the state it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IXth, Gaya, in connection with Tekari P.S. Case No. 344 of 2015 (G.R. No. 4364 of 2015).
