The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 452, 332, 333, 435, 436, 337, 338, 323, 224, 225, 307, 153(AA), 342, 160, 379, 120B, 353 of the Indian Penal Code and Sections 3 and 4 of Prevention of Damage to Public Property Act.

The prosecution case in short is that the accused persons making unlawful assembly attacked on informant and other police party, ransacked them and pelted stones due to which they sustained injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.1.2019 and has got no

Patna High Court CR. MISC. No.17979 of 2019(2) dt.11-04-2019 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. There is no substantive evidence to suggest his implication in the present case. Altogether 101 persons have been named in the F.I.R. along with two thousands unknown persons. Other co-accused have been granted anticipatory bail vide order dated 4.4.2019 passed in Cr. Misc. No. 21142 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Ramgarh P.S.
