The petitioners are languishing in custody since 23.02.2016 in connection with Medini Chowki P.S. Case No. 60 of 2015 registered for the offences under Sections 147, 148, 341, 323, 504, 506/302 of the Indian Penal Code.
The prosecution story, in brief, is that on 21.08.2015 the informant made her statement in Sadar Hospital, Munger alleging therein that on 18.08.2015 accused having lathi danda in their hand started abusing her and also assaulted her and when Nirmala Devi daughter of informant came to rescue, she was also brutally assaulted. The accused Rohit Mahto, Bipin Mahto, wives of Rohit Mahto, Bipin Mahto and Sanjay Mahto and one unknown had
Patna High Court Cr.Misc. No.28630 of 2016 (3) dt.30-08-2016 2/2 tried to kill her daughter Nirmala Devi and took her goat with them.
On behalf of the petitioners, it is submitted that the petitioners are in custody since 23.02.2016. Charge-sheet has been submitted in the present case. The petitioners have got no criminal antecedent. There is no allegation of tempering of witnesses alleged against the petitioners. Only general and omnibus allegation has been made against them. No specific allegation of assault has been made against the petitioners. On behalf of the State and the counsel for the informant, it has been submitted that the petitioners are named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Medini Chowki P.S. Case No. 60 of 2015.
