====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2025 Heard learned counsel for the petitioner and the State.
2. The petitioner seeks regular bail in a case registered for the offence punishable under sections sections 8(b), 18(b), 20(b) (ii) (c) and 29 of the NDPS Act.
3. As per the prosecution case, petitioner and other accused persons were found involved in cultivating opium in the field.
4. Learned counsel appearing for the petitioner submits that the allegation is vague as no description of filed has been given on which opium was cultivated. Moreover, petitioner is land less labour and co-accused, with similar allegation, has already been allowed regular bail by a co-ordinate bench of this Court in Cr.Mis.No. 13786/2025. Petitioner claims clean antecedent. Petitioner is in custody since 12.2.2025. Charge sheet has already been submitted.
5. Learned counsel for the State opposes the prayer for bail.
6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. Let the petitioner,
