The petitioner seeks bail in connection with Kesariya Police Station Case No. 108 of 2011 registered for offences punishable under sections 147, 148, 149, 447, 448, 341, 323, 324, 307, 380 and 504 of the Indian Penal Code.
It has been submitted that altogether 6 FIR named accused came at the place of informant and assaulted the informant and his father. The allegation of assault is specific against the other co-accused. The allegation against this petitioner appears omnibus. So far antecedent is concerned, the learned counsel for the petitioner submits that out of four cases, this petitioner has not been sent up in two cases and third case is
Patna High Court Cr.Misc. No.56995 of 2017 (2) dt.13-12-2017 2/2 complaint case filed by the informant himself and the petitioner is on bail in 4th case. He is in custody since 09.08.2017. Considering the facts and circumstances of the case, the prayer for bail of this petitioner is allowed and he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Motihari (East Champaran) in connection with Kesariya Police Station Case No. 108 of 2011.
