The petitioners are apprehending their arrest in a case in connection with Majhaulia P.S. Case No. 558 of 2020 pending in the Court of learned 6th Additional Sessions Judgecum-Special Judge, under POCSO Act, West Champaran, Bettiah registered for the offences punishable Sections 366A/34 of the Indian Penal Code and Section 12 of the POCSO Act. It is a case of abduction of the informant's daughter who is aged about 15 years, by the petitioners and other accused persons.
It is submitted by learned counsel for the petitioners
Patna High Court CR. MISC. No.28713 of 2021(3) dt.09-03-2022 2/2 that the petitioners have falsely been implicated in this case. He further submits that the petitioners have got clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.
From perusal of the FIR as well as the statement of the victim girl recorded under Section 164 of the Cr.P.C., it appears that there is specific involvement of the petitioners in abduction of the victim girl and took her away at the unknown place by wrapping her both eyes with cloth, which is an act of serious offence, as such, I am not inclined to grant anticipatory bail to the petitioners.
Prayer for anticipatory bail is rejected.
