JUSTICE MUNGESHWAR SAHOO ORAL ORDER 07-01-2015 The learned counsel, Mr. Sunil Kumar, for the appellant submitted that by mistake, the Misc. Appeal has been filed before this Court, although the valuation of the appeal is only Rs.50,000/. Therefore, the Misc. Appeal is maintainable before the District Judge concerned. On this ground, the learned counsel submitted that the memo of appeal may be returned to him so that the same may be presented before appropriate forum. Accordingly, the office is directed to return the memo of appeal to the appellant within ten days.

The learned counsel shall receive the memo of appeal from the office within ten days and then re-file the same as early as possible before appropriate forum. If any limitation application shall be filed with the memo of appeal, the same shall be considered according to law by the Court concerned. This Misc. Appeal is accordingly disposed of with the aforesaid direction.
