JUSTICE RAKESH KUMAR ORAL ORDER 13-07-2016 Heard Sri Umesh Kumar, learned counsel for the petitioner and Mr. Md. Arif, learned Addl. Public Prosecutor. This is the second attempt for grant of bail. Earlier the prayer for bail of the petitioner was rejected on 01.12.2015 vide Cr.Misc.No.52078 of 2015. While dismissing, keeping in view the fact that one of the co-accused, namely, Pappu Yadav was granted bail by this Court on completion of nine months in custody, the prayer for bail of the petitioner was rejected on last occasion since he had not completed nine months. After completion of nine months, the petitioner has renewed his prayer for bail.

Learned Addl. Public Prosecutor has vehemently opposed the prayer for bail of the petitioner.

Patna High Court Cr.Misc. No.28283 of 2016 (2) dt.13-07-2016 2/2 Accordingly, in view of observation given in Cr.Misc.No.52078 of 2015, let the petitioner, namely, Munni Yadav be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-IX, Gaya in connection with Khijarsarai P.S.

Case no.19/2015/S.Tr.No.59/2016 with conditions that (i) one of the bailors must be blood relation of the petitioner and (ii) during the trial, the petitioner shall remain physically present before the trial court on each and every date. If continuously on two dates, the petitioner fails to appear before the trial court without prior permission of the trial court, his bail bond shall stand automatically cancelled.
