JUSTICE ARUN KUMAR ORAL ORDER 15-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Abadpur PS Case No. 111 of 2017 registered under Sections 323, 376 and 504/34 of the IPC.

The allegation in brief is that the complainant, a married woman, was one day raped by the petitioner in her house. Learned Counsel for the petitioner submits that the complainant is a married women, the date of occurrence is mentioned as February 20017 whereas the complaint was filed on 28.5.2017 and no paternity test was done in this case. The petitioner is in custody since 24.11.2017.

Having considered the said facts and circumstances, the petitioner, namely, Taisul is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, lst Class, Katihar in connection with Abadpur PS Case No. 111 of 2017.
