The petitioners apprehend their arrest in Ramgarhwa P.S. Case No. 68 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. Pinki Kumari named the petitioners and alleged that they having armed with different weapons came and enquired about her father. When the informant replied that her father was not in the house then Shailesh Thakur assaulted her with Garasa on her head.
Learned counsel for the petitioners submits that this is counterblast of Ramgarhwa P.S. Case No. 65 of 2014 lodged by Shailesh Thakur in which Shailesh Thakur and others were
Patna High Court Cr.Misc. No.40451 of 2014 (2) dt.25-03-2015 2/2 brutally injured. The occurrence took place within the premises of Ramgarhwa police station, but the informant came to Motihari and lodged the case.
Considering the facts aforesaid and the fact that the informant got simple injury and there is no allegation of assault against the petitioners and others except Shailesh Thakur, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Sikrahana Raxaul, East Champaran in connection with Ramgarhwa P.S. Case No. 68 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
