The petitioner seeks regular bail in connection with Tajpur ( Waini O.P.) P. S. Case No. 117 of 2017 registered for offences punishable under Section 414 of the Indian Penal Code and Sections 25 (1-B)A, 26 and 35 of the Arms Act. The prosecution case as lodged on the basis of self written report of Sub Inspector, Rajpur (Waini) O.P. is that on secret information police apprehended six persons including the petitioner and from the joint possession of the petitioner, one loaded country made pistol with one live cartridge and a mobile was recovered. Some vehicles were also found from the joint possession of the petitioner and other co-accused and charge sheet
Patna High Court Cr.Misc. No.59481 of 2017 (3) dt.15-01-2018 2/2 has been submitted against the petitioner under Section 414 of the Indian Penal Code and 25 (1-B)A, 35 and 26 Arms Act. It has been submitted in para-8 of the petition that coaccused Ranjan Kumar @ Balajee has been granted bail on 31.10.2017 vide Cr. Misc. No. 39879 of 2017. It has been submitted that the allegation against the petitioner is general and omnibus and he is in jail since 24.04.2017.
Considering the facts and circumstances and the materials on record, let the petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- 1st, Samastipur in connection with Tajpur (Waini) P.S.
