JUSTICE SANJAY PRIYA ORAL ORDER 2/ 05-10-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in Begusarai Town P.S. Case No.659 of 2017 instituted for the offence under Section(s) 302, 120(B)/34 Indian Penal Code and 27 of Arms Act. Counsel for the petitioner submits that mere suspicion has been raised against the petitioner in the written report. Petitioner is in custody since 15.05.2018. In the written report, it is alleged by the informant that her Nanad is living with her. She was tortured in her Sasural by her husband, Lalita Choudhary, and his family members. It is also alleged that she has filed a case against her husband and his family members including this petitioner for the offence under

Patna High Court Cr.Misc. No.61245 of 2018 (2) dt.05-10-2018 2/2 Section 498-A Indian Penal Code. They always gave threat to withdraw the case. It is suspected that due to aforesaid case, the petitioner, who is the father-in-law of her Nanad, has committed murder of her husband.

In this manner, mere suspicion has been raised against the petitioner.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Begusarai Town P.S. Case No.659 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
