This is a case registered under Sections 341,323,307,379,504/34 and 302 of the Indian Penal Code in connection with Amarpur P.S. Case No. 165 of 2017 pending in the Court of Chief Judicial Magistrate, Banka. It is submitted by the counsel for the petitioner that no specific allegation has been attributed regarding the manner of assault upon the instant petitioner.

It is apparent from the FIR that the informant has died subsequently as a result of injury caused by lathi, danda and iron rod by the petitioner and others.

In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail.

The prayer is rejected.
