JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,323,324,354,509 and 379 of the Indian Penal Code. It is alleged that the accused persons assaulted the informant. The petitioner is alleged to have torn the blouse of the informant.
It is submitted by the learned counsel for the petitioner that the informant received two bruise injuries, one on the right wrist and the other on left arm though opinion with regard to the injuries was kept reserved. It is further submitted that the accusation of assault is omnibus and general. The petitioner is a student of IIT, Mumbai and for the petty dispute the accusation
Patna High Court Cr.Misc. No.34654 of 2015 (2) dt.17-08-2015 2/2 has been levelled and other accused persons have been granted anticipatory bail. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the accusation of assault being omnibus and general and that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Lalganj P.S. Case No.102 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
