Petitioner seeks bail in Naubatpur P.S. Case No. 213 of 2018 instituted for the offence under Section(s) 25(1-B)a, 35 of the Arms Act.

Petitioner is said to be in custody since 04.06.2018. In the written report, it is alleged that the police on getting information that accident has taken place has reached the place of occurrence and found Sujit Kumar inside the vehicle. One Soni Kumari, who was alive, was recovered from the vehicle.

It is mentioned in the impugned order that Investigating Officer has obtained CDR, as mentioned in para 22

Patna High Court Cr.Misc. No.55588 of 2018 (2) dt.20-09-2018 2/2 of the case diary, which shows that holder of Mobile No.7992375042 is Sujit Kumar and call was made from Mobile No.7992375042 to Mobile No.9304998157. It is also alleged that holder of Mobile No.9304998157 is petitioner. Besides this, there is no other allegation against the petitioner. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, 1st, Danapur, Patna, in connection with Naubatpur P.S. Case No. 213 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
