Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Allegation against the petitioner is that for property dispute, he along with his brother caused murder of his father. The Doctor has found head injury as cause of death. Submission of the learned counsel for the petitioner is that the petitioner is in custody since 18.07.2017. There is no eye-witness of the occurrence of actual assault, allegedly, committed by the petitioner. Only suspicion is there for the reason that the occurrence took place inside the house. Patna High Court Cr.Misc. No.1118 of 2018 (4) dt.14-03-2018 2/2 inclined to enlarge the petitioner on bail for the present in connection with Nimchak Bathani Police Station Case No. 45 of 2014 pending in the court of learned 10th Additional Chief Judicial Magistrate, Gaya.

Hence, prayer for bail is refused.

However, the petitioner would be at liberty to renew his prayer for bail before the court below itself, if the trial is not concluded within a period of six months from the date of receipt/production of a copy of this order.
